Multi Units Developments Act (MUD)

D-Day today for new apartment legislation

Today is a good day for many apartment owners and occupiers. Under the new MUD legislation the common areas of any apartment developments caught up in NAMA or with developers who failed to sell all units finally come under the ownership of residents.

Thankfully this is not a problem for Diamond Valley residents. Because our development is a bit more mature we have had ownership of our common areas for some years now.

Not being under the control of developers has allowed us to have a strong management committee of apartment owners who have a vested interest in keeping the development in good condition and looking well.

There are however parts of the new MUD Act that apply to us including the court enforcable obligation to pay service charges and the obligation in law for owners and tenants to comply with house rules.
